Terms of Service

These terms are an agreement between you and FluentWin, an AI English coaching app operated by its founder from Nepal. By creating an account or using the app, you agree to them. If you have a question about anything here, write to hello@fluentwin.com.

1. What FluentWin is

FluentWin helps you practise spoken English with an AI coach. It includes live speaking sessions, IELTS speaking practice, reading, and exercises, with feedback and estimated scores. The coach is an AI. There is no human tutor in the sessions.

2. Scores are estimates

Band scores and feedback in FluentWin are estimates produced by AI to guide your practice. They are not official IELTS results and they do not predict or guarantee any exam outcome. FluentWin is not affiliated with or endorsed by IELTS, the British Council, IDP, or Cambridge.

3. Your account

You can start as a guest, with an account tied to your device. To keep your progress across devices, sign in with Google, Apple, or an email code. We do not use or store passwords. You are responsible for keeping access to the email address or provider account you sign in with.

You must be at least 13 years old, or the age of digital consent in your country if it is higher, to use FluentWin.

4. Acceptable use

Use FluentWin for your own learning. You agree not to:

• abuse the coaching service, or try to make the coach produce harmful or unrelated content
• reverse engineer, scrape, or copy the service, its content, or its models
• resell access, share your account commercially, or use the service to build a competing product
• interfere with the operation or security of the service, or use it to break the law

We may suspend or close an account that breaks these rules.

5. Subscriptions and payment

Paid plans are bought through the Apple App Store or Google Play. Billing, renewal, cancellation, and refunds are handled by the store under its own terms, and we never receive your card details. Prices can differ by country. Free features and usage limits may change over time.

6. Your content and ours

What you say and write in your sessions is yours. You give us permission to process it to run the service, for example to produce transcripts, feedback, and your practice records, as described in our Privacy Policy. The app, its lessons, exercises, coach, and brand belong to FluentWin. Please do not copy or redistribute them.

7. The service is provided as is

We work hard to keep FluentWin accurate and available, but it is provided as is, without warranties. AI can make mistakes, and the service may occasionally be interrupted or change.

8. Limitation of liability

To the extent permitted by law, our total liability for any claim related to the service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect losses, or for the result of any exam you take.

9. Ending things

You can delete your account in the app at any time. Deletion takes effect after a 30 day grace period, in case you change your mind. You can also ask us by email. We may end or suspend access for a breach of these terms, and we may discontinue the service with reasonable notice.

10. Changes to these terms

We may update these terms as the product evolves. If a change is material, we will tell you in the app or by email before it takes effect. Using FluentWin after that means you accept the updated terms.

11. Governing law

These terms are governed by the laws of Nepal, and disputes belong to the courts of Nepal. If the consumer law of your country gives you rights that cannot be waived, those rights are not affected.
